Terms & Conditions

1. DEFINITIONS

  • “Company” means AutoMallSL UK LTD, registered in England & Wales under company number 16250442, with registered office at 406, 55 Hooper Street, Birmingham B18 7AT.
  • “Platform” means the Company’s website and associated services.
  • “Customer” means any individual or business accessing or using the Platform to place inquiries, order vehicles, or obtain services.
  • “Services” means the virtual car dealership, export/import facilitation, spare parts procurement, and related consultation services offered via the Platform.
  • “Inquiry Fee” means the initial payment charged to Customers when submitting a purchase inquiry.

2. ACCEPTANCE OF TERMS

By creating an account, submitting an inquiry, or otherwise using the Platform, the Customer acknowledges having read, understood, and agreed to these Terms & Conditions. These Terms form a legally binding agreement between the Customer and the Company.

3. ELIGIBILITY

3.1 Use of the Platform is strictly limited to persons aged 18 or older. Minors are prohibited from creating accounts or using the Services.
3.2 The Services are offered to, subject to these Terms.

4. ACCOUNTS & SECURITY

4.1 Customers must provide accurate and complete registration details, including full name, address, contact number, and email.
4.2 Account access is protected via password and two-factor authentication (email OTP). Customers are responsible for maintaining confidentiality and all activity under their account.

5. SERVICES PROVIDED

5.1 The Company operates as a virtual car dealership, enabling Customers to browse available vehicles and related services online.
5.2 Upon submitting an inquiry and paying the Inquiry Fee, the Company will source vehicles and facilitate importation to Sri Lanka on behalf of Customers.
5.3 The Company does not guarantee availability of specific vehicles, shipping dates, or delivery timelines.

6. PAYMENTS, TAXES & REFUNDS

6.1 The Inquiry Fee is payable online through the Platform.
6.2 All subsequent payments, including but not limited to car price, insurance, freight, taxes, shipping, and service charges, shall be conducted off-platform directly between the Customer and the Company or designated third parties.
6.3 Refund Policy: The Inquiry Fee is refundable only if requested within 3 business days of payment. After this period, the Inquiry Fee is strictly non-refundable.
6.4 All other payments are non-refundable once services commence.
6.5 Customers are solely responsible for payment of all taxes, import duties, clearance charges, and related fees.

7. USER-GENERATED CONTENT

7.1 Customers may upload documents or images to support their inquiries or transactions.
7.2 By uploading content, Customers grant the Company an unrestricted, worldwide license to host, store, and process such content for the purposes of fulfilling the Services.
7.3 The Company may aggregate or anonymise Customer data for internal analytics and product improvement.

8. ACCEPTABLE USE

8.1 Customers agree not to use the Platform for unlawful purposes, fraud, harassment, distribution of harmful code, reverse engineering, scraping, or spam.
8.2 The Company reserves the right to restrict access in case of prohibited conduct.

9. INTELLECTUAL PROPERTY

9.1 All intellectual property on the Platform, trademarks, designs, and proprietary content, remains the exclusive property of the Company.
9.2 Customers may not copy, reproduce, or distribute Company content without prior written consent.

10. DISCLAIMERS & WARRANTIES

10.1 The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without any express or implied warranties.
10.2 The Company does not warrant that vehicles will meet Customer expectations, that shipping will be timely, or that services will be uninterrupted or error-free.

11. LIMITATION OF LIABILITY

11.1 To the fullest extent permitted by law, the Company shall bear no liability whatsoever for any loss, damage, cost, expense, or claim arising from or relating to:

  • Purchase, shipment, or delivery of vehicles or parts;
  • Customs clearance, taxes, or insurance;
  • Delays, losses, accidents, or damages in transit;
  • Use or misuse of the Platform;
  • Any indirect, incidental, or consequential damages.

11.2 All transactions are undertaken at the sole risk of the Customer.

12. DISPUTE RESOLUTION

12.1 All disputes shall be resolved exclusively through arbitration, conducted under the rules applicable in the governing jurisdiction.
12.2 Governing law shall be the laws of England & Wales and, where applicable, the laws of Sri Lanka.

13. TERMINATION & SUSPENSION

13.1 The Company may suspend or terminate any Customer account, with or without notice, if:
• The Customer breaches these Terms;
• The Customer engages in fraudulent, illegal, or abusive conduct;
• The Company is required to do so by law or regulatory authority.

13.2 Customers may request closure of their account at any time by submitting a written request to info@automallsl.co.uk.
13.3 Termination shall not affect any obligations already incurred by the Customer (including payments, taxes, or shipping costs).

14. MODIFICATIONS

14.1 The Company may update these Terms by notice via email and in-app notification.
14.2 Continued use of the Platform after changes constitutes acceptance of the revised Terms.

15. COPYRIGHT COMPLAINTS & TAKEDOWN

15.1 The Company respects intellectual property rights. If you believe that content uploaded to the Platform infringes your copyright, you may submit a written notice including:
(a) Identification of the work claimed to be infringed;
(b) Identification of the material claimed to be infringing;
(c) Your contact details;
(d) A statement under penalty of perjury that you are the rights holder or authorized agent.

15.2 Upon valid notice, the Company may remove or disable access to the alleged infringing material.
15.3 The Company may, at its discretion, suspend or terminate accounts of repeat infringers.

16. PRIVACY POLICY

16.1 The Company processes personal data in accordance with its Privacy Policy.
16.2 By using the Platform, Customers acknowledge and agree to the terms of the Privacy Policy.

17. MISCELLANEOUS

17.1 Severability: If any provision of these Terms is invalid, the remainder shall remain enforceable.
17.2 Entire Agreement: These Terms constitute the full agreement between the Company and the Customer.
